Accretion: Terms of Service

By downloading, accessing, or playing Accretion: Pebbles of Time ("the Game"), you agree to these Terms. If you do not agree, do not use the Game. These Terms incorporate the Privacy Policy and Refund Policy.

1. Eligibility

You must be at least 13 years old (or the higher minimum digital-consent age in your region) to use the Game. If you are a minor in your jurisdiction, you may use the Game only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms.

2. License

Zorath grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and play the Game for your own non-commercial entertainment, subject to these Terms and the rules of the platform you obtained it from (Google Play; the web). All rights not expressly granted are reserved.

3. Ownership

The Game and all related content (including the Z-Engine technology, code, art, audio, cinematics, names, and trademarks) are owned by Zorath LLC and protected by intellectual-property laws. You receive no ownership rights. You may not copy, modify, reverse engineer (except where that restriction is prohibited by law), distribute, sell, rent, or create derivative works from the Game except as expressly permitted.

4. Purchases, virtual items, and entitlements

The Game may offer optional purchases (e.g., cosmetic or convenience items, or removal of limits). Prices are shown before purchase.
Web purchases are sold by Paddle as Merchant of Record; Android purchases are processed by Google Play Billing. Your purchase is also subject to that provider's terms.
Virtual items and entitlements are a limited license to use them within the Game. They have no monetary value, are not your property, cannot be redeemed for cash, and may be unavailable if the Game is discontinued, subject to applicable law and the Refund Policy.
Entitlements are validated server-side against your account where online features are used. We may revoke items obtained through fraud, chargeback abuse, exploits, or error.

5. Accounts

An account is optional and only needed for cross-device cloud save. You are responsible for activity under your account and for keeping your credentials secure. Provide accurate information. We may suspend or terminate accounts that violate these Terms.

Communications. When you create an account or join the Accretion beta, you agree that Zorath LLC may email you about the beta and the Game, including new builds, playtest information, and occasional studio updates. You can opt out of these at any time using the unsubscribe link in any such email. You may still receive essential service messages (such as your access link or account and security notices); these are not marketing and are not subject to unsubscribe.

6. Acceptable use

You agree not to: cheat, use unauthorized third-party software, bots, or memory editors to gain an unfair advantage or manipulate progress, scores, or purchases; disrupt or attack our servers; infringe others' rights; or use the Game unlawfully.

7. Availability and changes

The Game is provided as an evolving service. We may update, change, suspend, or discontinue features (or the Game) at any time, and may patch balance, content, and pricing. We are not liable for changes to virtual items resulting from ordinary updates.

8. Disclaimers

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain disclaimers, so parts may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZORATH WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST DATA/PROFITS, ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (a) AMOUNTS YOU PAID US FOR THE GAME IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) to be finalized USD. This does not limit liability that cannot be limited by law (e.g., for gross negligence, fraud, or death/personal injury caused by negligence).

10. Indemnity

You agree to indemnify Zorath against claims arising from your misuse of the Game or violation of these Terms, to the extent permitted by law.

11. Termination

You may stop using the Game at any time. We may suspend or terminate your access for breach of these Terms. Sections that by their nature should survive (ownership, disclaimers, liability, governing law) survive termination.

12. Governing law and disputes

These Terms are governed by the laws of to be finalized, USA, without regard to conflict-of-laws rules. to be finalized Mandatory consumer-protection rights in your country of residence are unaffected.
